Terms of Service

PitchMachine discovers prospective businesses from public search results, audits their public online presence, and drafts personalised outreach emails you can review, edit, and send. Optionally it can place those drafts into your Gmail account.

Every draft is exactly that — a draft. Nothing is sent automatically. You decide what goes out.

• You must be at least 16 years old and able to enter a contract.
• Give accurate sign-up information and keep your credentials secure.
• You are responsible for everything done through your account.
• Tell us promptly if you believe your account has been accessed by someone else.

PitchMachine does not resell AI or search capacity. You supply your own API keys and the calls the app makes run under your own accounts with those providers, at their prices and under their terms.

• Any charges those providers bill you are yours to pay.
• If a key is invalid, out of quota, or rate-limited, the affected feature will not work until you resolve it with that provider.
• We apply per-user rate limits on expensive operations to protect the service and to reduce the risk of runaway spend, but we cannot guarantee a spending ceiling on your provider account.

You agree not to:

• Send unlawful, deceptive, harassing, or bulk unsolicited email using content produced by the service.
• Use the service to collect personal data for any purpose that breaks applicable law.
• Attempt to access another user's data, probe or disrupt the service, or bypass rate limits and security controls.
• Scrape or overload third-party websites through the service.
• Resell or redistribute the service without our written permission.

You are the sender of every email you send. Complying with the anti-spam and data protection law that applies to you and to your recipients — including CAN-SPAM, GDPR, UK GDPR, PECR, CASL, and India's DPDP Act where relevant — is your responsibility, not ours.

That includes having a lawful basis for contacting a business, identifying yourself honestly, honouring opt-out requests, and not contacting anyone who has asked you to stop.

Audits are built from publicly available information and from output produced by large-language models. They can be incomplete or wrong. A site may block our request, a model may misread a page, and a business may have changed since it was last indexed.

Read every draft before you send it. Do not present an audit finding to a prospect as established fact without checking it yourself.

You keep ownership of your profile, your leads, and the emails you send. You grant us only the permission needed to store and process that content in order to run the service for you. We do not use your content to train models.

The service is provided on an "as is" and "as available" basis. We do not promise uninterrupted operation. Features that depend on third parties — search providers, AI providers, Gmail — can fail for reasons outside our control.

You may stop using the service and request deletion of your account at any time. We may suspend or terminate an account that breaches these terms, that is being used to send unlawful email, or that threatens the security or stability of the service.

To the fullest extent the law allows, PitchMachine is not liable for indirect or consequential loss, for lost profit or business, or for provider fees you incur through your own keys. Nothing in these terms limits liability that cannot lawfully be limited.

We may update these terms. The date at the top will change and, for material changes, we will notify account holders. Continuing to use the service after a change means you accept the updated terms.
